Governing Law: Malaysia

Please read these terms carefully before using this website or engaging Saksama Legal. By accessing saksamal.pro or submitting an enquiry, you agree to be bound by these terms. If you do not agree, please do not use this website.

1. Definitions

In these terms, the following words have the meanings given below:

2. Acceptance of Terms

These terms apply to all users of the Website. Use of the Website or submission of an enquiry constitutes acceptance. You must be at least 18 years old and legally capable of entering a binding agreement to use this Website or engage our services.

3. Website and Service Description

This Website provides general information about Saksama Legal and its practice areas. The information on this Website does not constitute legal advice and should not be relied upon as such. Legal advice is provided only to Clients under a formal engagement agreement.

Our Services are available to clients located in Malaysia and to foreign nationals and entities seeking advice on Malaysian corporate law. We do not provide advice on the laws of jurisdictions other than Malaysia.

4. No Attorney-Client Relationship

Visiting this Website or submitting an enquiry does not create an attorney-client relationship. An attorney-client relationship is established only when both parties have signed a written engagement letter and the relevant fee has been agreed. Until that point, we are under no obligation to maintain confidentiality in respect of information you share with us through this Website.

5. User Obligations

When using this Website or communicating with us, you agree to:

6. Intellectual Property

All content on this Website — including text, design, structure, and materials — is owned by or licensed to Saksama Legal. No part of this Website may be reproduced, distributed, or transmitted without our prior written consent, except for personal, non-commercial reference.

Nothing in these terms grants you any licence to use our trade name, trademarks, or other intellectual property.

7. Service Terms for Clients

Legal services are provided only under a written engagement letter that sets out the specific scope, fees, timeline, and terms applicable to each matter. In the event of any conflict between these Website terms and the engagement letter, the engagement letter will prevail in respect of the services described therein.

Payment terms

Fees are denominated in Malaysian Ringgit (RM). Payment terms and methods are set out in the engagement letter. Fees must be paid as and when invoiced unless alternative payment stages have been agreed in writing. We reserve the right to suspend work on a matter in the event of non-payment of an overdue invoice.

Refund policy

Fees paid for work already completed are non-refundable. If an engagement is terminated before completion, fees will be payable for work done to the date of termination, calculated on a time-and-materials basis at the agreed rate unless a fixed-fee arrangement has been documented.

8. Disclaimers

The content on this Website is provided for general information purposes only. It is not, and should not be treated as, legal advice. We do not make any representation or warrant that the information on this Website is accurate, complete, or current.

We do not warrant that the Website will be available at all times or free from errors or viruses. Access to the Website is provided on an "as is" basis.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law, Saksama Legal shall not be liable for any indirect, incidental, or consequential loss arising from use of this Website or reliance on its content. Our total liability in connection with any claim arising from the use of this Website (not in the context of an engagement) shall not exceed RM 500.

Liability in connection with legal services provided under an engagement letter is governed by the terms of that engagement letter and applicable professional obligations.

10. Indemnification

You agree to indemnify and hold Saksama Legal harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these terms or misuse of this Website.

11. Termination

We may terminate or suspend your access to the Website at any time without notice if we believe you have breached these terms or engaged in harmful conduct. Termination of Website access does not affect any obligations under an existing engagement letter.

12. Dispute Resolution

These terms are governed by the laws of Malaysia. Any dispute arising from these terms shall be subject to the jurisdiction of the courts of Malaysia, with Kuala Lumpur as the seat. We encourage parties to first attempt informal resolution by contacting us at [email protected] before commencing formal proceedings.

Failure to enforce any provision of these terms at any time does not constitute a waiver of our rights to enforce that provision in the future.

Assignment

You may not assign your rights or obligations under these terms without our written consent. We may assign our rights in connection with a restructuring of our practice.

14. Changes to These Terms

We may update these terms from time to time. Updated terms will be published on this page with a revised effective date. Continued use of the Website after the effective date of an update constitutes acceptance of the revised terms.
